摘　　要：党的二十届三中全会明确提出,完善推动新一代信息技术、人工智能等战略性产业发展政策和治理体系,同时要求加强和改进青少年权益保护。数字时代所形塑的算法社会,对青年群体的权益容易造成多重侵害风险。“算法偏见”在智能招聘中容易形成歧视,对青年的平等就业权具有侵害风险;基于算法的精准监控而形成的“算法控制”,对青年的劳动保障权具有侵害风险;“算法诱导”容易使青少年形成数字成瘾,从而危害其身心健康权;算法自动化决策的普遍应用会对人的主体性带来挑战,进而替代甚至消解青年的参与权。应对算法对青年群体的权益侵害风险,不仅要求法律对事关青年生存和发展的关键权利予以充分赋权和保障,还需明确国家权力行使的边界与规范,此外,也应当为平台权利的行使设定合理的框架和标准。The 20th Central Committee of the Communist Party of China explicitly proposed improving policies and governance systems to promote the development of strategic industries such as next-generation information technology and artificial intelligence.At the same time,it emphasized the need to strengthen and improve the protection of youth rights and interests.In the digital age shaped by algorithmic society,the rights of young people are at risk of multiple violations."Algorithmic bias"in intelligent recruitment can lead to discrimination,jeopardizing young people's right to equal employment."Algorithmic control"formed by algorithm-driven precise monitoring poses risks to young workers'labor protection rights."Algorithmic inducement"may lead to digital addiction among adolescents,harming their physical and mental health rights.The widespread application of algorithmic decision-making challenges human agency,potentially undermining or even eliminating young people's right to participation.Addressing the risks posed by algorithms to youth rights requires legal frameworks to fully empower and protect key rights critical to youth survival and development.Additionally,it is essential to delineate the boundaries and norms for the exercise of state power,and establish reasonable frameworks and standards for platform operators.
