国际知识产权规则发展与中国因应——基于CPTPP、USMCA、EJEPA和RCEP的比较

摘　　要：知识产权规则变革是全球经贸规则重构的重要内容,也是中国对接国际高标准规则、推动制度型开放的重要领域。当前,国际知识产权规则发展呈现出保护客体不断扩展、保护强度显著升级、执法措施更趋严格、规则体系由多边转向区域、规则诉求更加多元等趋势。通过比较CPTPP、USMCA、EJEPA、RCEP等大型区域贸易协定中的专利、商标、著作权、地理标志、工业设计、未披露试验数据等重点领域的知识产权保护规则以及国际条约、执法条款、过渡期条款、倡导性条款、透明度条款、例外条款等重点条款的规则细节,对全球知识产权规则水平作出全景梳理。在此基础上,分析国内知识产权规则与国际知识产权规则在目标导向、保护内容、执法措施等方面存在的分歧和差异,并从推动多双边谈判、构建规则范式、深化共建“一带一路”合作、发挥试点平台作用、完善法律法规等角度提出中国因应之策。The transformation of intellectual property rules is an important part of the restruc-turing of global economic and trade rules,and is also an important area for China to connect with international high standard rules and promote institutional opening up.At present,the development of international intellectual property rules shows a trend of expanding the scope of protection,strengthening and upgrading the intensity of protection,stricter enforcement measures,transition of the rule system from the multilateral to regional level as well more diverse rule demands.By comparing details of key areas such as patents,trademarks,copyrights,geographical indications,in-dustrial design and undisclosed experimental data,and key clauses such as international treaties,en-forcement provisions,transitional provisions,advocacy provisions,transparency provisions,excep-tion provisions in large economic and trade agreements such as CPTPP,USMCA,EJEPA and RCEP,the paper provides a comprehensive overview of the global intellectual property rule sys-tem.On this basis,it analyzes the differences between domestic intellectual property rules and in-ternational standards in terms of target orientation,protection content,enforcement measures and proposes China's countermeasures such as promoting multilateral and bilateral negotiations,building rule paradigms,deepening"the Belt and Road"cooperation,playing the role of pilot platforms as well as improving laws and regulations.
