摘　　要：恰当的分析框架有助于更好地理解中国法院变革。以往,人们侧重从内在视角理解中国法院变革,但这不足以充分揭示推动中国法院变革的不同动力,展现中国法院变革的丰富实践,揭示法院在人们所熟悉的国内关系领域之外的一个领域,即对外关系领域的作用与功能及其发展。对外关系法为理解法院变革提供了新视角。基于对外关系法视角,根据中国与国际体系互动模式的变迁,可以建立一个分析框架,即从中国融入全球化、重塑全球化以及开展国际博弈三个方面或三个支柱考察中国法院变革的动力与实践。这一分析框架有助于全面揭示法院变革的动力,展现中国法院的诸多创新性变革措施,检视既有变革措施并探索后续实践。中国法院根据中国与国际体系互动的发展积极推动自身变革,同时助力实现国家的对外关系目标。在理解与助力实现对外关系目标方面,中国法院展现出高度的敏感性、进取性、灵活性与创造力。A proper framework is helpful to better understand the process of transformation of Chinese courts.People used to look into such process from an intermal perspective.This perspective,however,cannot fully unearth the divergent impetuses underlying the process,unfold the diverse dimensions of the transformation,and therefore indicate the role,function and their evolution of Chinese courts in the field of foreign relations rather domestic relations which people know well.Foreign relations law provides a new perspective to understand such process.With this new perspective and based on the evolution of the interaction between China and international order,a framework is developed with three pillars,including China's efforts to integrate into globalization,reshape globalization and undertake international struggles.This framework helps to reveal the overall impetus for Chinese courts'transformation,unfold their various innovative practice,and evaluate the reformative measures already undertaken while explore the potential.It is seen that Chinese courts,based on the evolutionary interaction between China and international order,continue the process of transformation while enhance the foreign policy goals.Chinese courts feature with sensibility,entrepreneurship,flexibility and creativity in terms of perceiving and realizing foreign policy goals.
