摘　　要：生态环境损害赔偿磋商协议司法确认制度是指,法院对经过双方当事人磋商达成的协议进行司法审查,确认其执行效力,从而保障协议在实际修复中的实施。该项制度上承环境损害鉴定评估,下接生态环境损害赔偿诉讼,在审视各省份试点改革方案及典型案例的基础上,设置特别的程序规则,对缺失问题提出相应的完善路径,实现了诉讼与磋商制度在效力上的衔接,提高了磋商协议的公共理性与可接受性,为我国解决环境损害赔偿问题提供了新的救济途径。The judicial confirmation system for consultation agreements on compensation for ecological environmental damage involves the court reviewing and confirming the enforceability of agreements reached through negotiation between the parties,thereby ensuring their implementation in actual restoration efforts.This system bridges the gap between environmental damage assessment and compensation litigation.Based on an examination of pilot reform programs and typical cases across various provinces,the paper establishes special procedural rules,proposes improvements for missing elements,and achieves the integration of litigation and consultation systems in terms of effectiveness.It enhances the public rationality and acceptability of consultation agreements,providing a new remedy for resolving issues of environmental damage compensation in China.
