温室气体自愿减排项目质押融资法律问题研究

摘　　要：随着全国温室气体自愿减排交易市场的重启,商业银行在发展绿色金融业务的同时,也对助力“双碳”目标的实现提出了更高要求。文章以温室气体自愿减排项目质押的基本理论为研究起点,分析质押业务的可行性与必要性,指出发展该质押业务将面临的政策风险、信用风险、操作风险、市场风险,并从完善法律规范、建立保险制度、加强商业银行体系建设和开发应用碳金融科技等方面,提出了进一步保障温室气体自愿减排项目质押业务顺利开展的对策建议。With the relaunch of the national GHG VER trading market,commercial banks have put forward higher requirements for achieving the"dual carbon"goal while carrying out green finance business.According to the basic theory of pledge for GHG VER programs,the thesis sets out to analyze the feasibility and necessity of pledge business,points out the policy risks,credit risks,operational risks and market risks in carrying out pledge business,and put forward proposals to further ensure the smooth operation of pledge business from the aspects of perfecting legal norms,setting up insurance systems,strengthening commercial banking system construction,developing and applying carbon finance technology.
