摘  要:环境监管中存在执法被动、监测不足、损害评估困难等问题。通过研究人工智能动态监控技术在环境执法中的应用情况,并探讨其在污染源实时监测、生态损害评估和环境风险预警等领域的创新实践,对于完善相关法律规制的创新路径具有重要意义。人工智能技术能够推动环境监管从被动执法向主动预防转变,但现行法律规制体系仍有待完善。基于此,文章提出通过健全监测数据标准规范、创新环境损害举证规则和明确生态修复责任体系等制度创新,构建“智能监管+法律规制”的协同治理机制,以提升生态环境执法质量。At present,there are issues such as passive law enforcement,insufficient monitoring and difficulty in damage assessment in environmental regulation.Studying the application of AI dynamic monitoring technologies in environmental law enforcement and exploring its application in real-time pollution source monitoring,ecological damage assessment,and environmental risk warning is of great significance for perfecting relevant regulations.AI can accelerate the transformation of environmental regulation from passive law enforcement to active prevention,but the current legal system still lagged behind.Based on this,the article proposes to establish a collaborative governance mechanism of“intelligent supervision+legal regulation”through institutional innovations such as improving monitoring data standards and specifications,innovating environmental damage proof rules,and clarifying the responsibility system for ecological restoration,so as to enhance the quality of law enforcement.
