法文化视域下社会主义核心价值观融入法治建设探究

摘　　要：社会主义核心价值观已全方位融入当下中国的法治建设,成为中国特色社会主义法治建设的灵魂。中华传统礼法文化在近代中国解体造成的社会治理困境以及当下中国对依法治国与以德治国相结合国家治理方式的强调,是社会主义核心价值观融入法治建设的文化背景。社会主义核心价值观创造性转化、创新性发展了传统德礼观念,增强了法治的道德底蕴。在立法方面,社会主义核心价值观大量入法入规,在形式上类似于中国中古时期法典编纂着力体现德礼的精神;在司法方面,社会主义核心价值观在释法说理中起到的作用,与古代司法裁判所追求的情理法整体性思维与一体化平衡艺术风格类似。社会主义核心价值观融入法治建设是当下中国重构“礼法”的尝试,蕴含了“德性法治”这种既在实践上具有中国特色又在理论上具有普世之维的法治文明新形态。The core socialist values have been comprehensively incorporated into the current development of rule of law in China,and become the soul of development of socialist rule of law with Chinese characteristics.The predicaments of social governance caused by the disintegration of traditional Chinese culture of rites-based law in modern China and the emphasis on the combination of rule of law and rule of virtue in current China are the cultural background of incorporating core socialist values into the development of rule of law.The core socialist values have creatively transformed and innovatively developed the traditional concepts of virtue and rites,thus enhancing the moral foundation for the rule of law.In terms of legislation,the incorporation of core socialist values into a lot of laws and regulations is in form similar to the rigorous embodiment of the spirit of virtue and rites in the codification of laws in medieval China.In terms of judicial practice,the proper role of core socialist values in the legal interpretation and reasoning is just like the holistic thinking of emotion,reason and law,and the artistic style of integrated balance pursued by the ancient judicial adjudication.The incorporation of core socialist values into the development of the rule of law is an attempt to reconstruct"rites-based law"in current China,which contains a new form of civilization in the rule of law with both Chinese characteristics in practice and universal dimension in theory,i.e.the"virtue-based rule of law".
