摘  要:近年来,在形式解释论和实质解释论的争论中,由于学术立场的差异,双方对于诸如目的解释等具体解释方法的态度泾渭分明,这在一定程度上影响了刑法解释方法的适用。与此同时,实务中出现由于机械理解刑法而进行的不当裁判。反思上述两种现象,根源在于缺乏交互思维。应当倡导刑法交互解释,刑法交互解释中的论证包括内部交互论证和内外交互论证两个环节。在内部交互论证中,强调不同解释方法之间的相互验证功能,在此基础上选择妥当的解释结论。在内外交互论证中,强调逻辑与经验的交互融通。在个案审理中,应摒弃机械理解构成要件的做法,适度关照经验知识对裁判结论的反思和纠偏功能。In recent years,in the debate between formal interpretation and substantive interpretation,due to differences in academic positions,both sides have distinct attitudes towards specific interpretation methods such as teleological interpretation,which to some extent affects the application of criminal law interpretation methods.At the same time,in practice,improper judgments are made due to mechanical understanding of criminal law.Reflecting on the above two phenomena,the root cause lies in the lack of interactive thinking.Interactive interpretation of criminal law should be advocated,in which the argumentation includes internal interactive argumentation and internal-external interactive argumentation.In terms of internal interactive argumentation,emphasis is placed on the function of mutual verification among different interpretation methods,thus choosing a proper interpretation conclusion on this basis.In terms of internal-external interactive argumentation,emphasis is placed on the interactive integration of logic and experience.In the trial of individual cases,the practice of mechanically understanding the constituent elements should be abandoned,and appropriate attention should be paid to the reflection and correction function of empirical knowledge on the judgment conclusion.
