摘 要:职务犯罪监检衔接机制的运作涉及两个主体和两个程序,具有不同的地位和性质,构建合作顺畅、相互制约的制度化监检衔接机制很有必要。对A省职务犯罪案件监检衔接工作进行调研分析,可以发现目前认罪认罚从宽有程序障碍、提前介入的衔接机制不完善、管辖分工衔接机制存在缺陷、退回补查的运行程序不够细化等问题亟待解决。为推进职务犯罪监检衔接工作,可从增设监检衔接特别程序、完善认罪认罚工作的衔接机制、明确提前介入的规制程序,厘清两机关各自管辖范围等方面进行制度完善,以强化制度实效。The operation of the coordination mechanism between supervision and procuratorial authorities in duty-related crimes involves two entities and two procedures,each with different statuses and natures.It is necessary to establish a well-functioning and mutually restrictive institutionalized coordination mechanism.Through an investigation and analysis of the coordination work in duty-related crime cases in Province A,it is evident that there are still issues to be resolved,such as procedural obstacles in the leniency system for guilty pleas,imperfect coordination mechanisms for early intervention,defects in the jurisdictional division mechanism,and insufficiently detailed procedures for returning cases for supplementary investigation.To advance the coordination between supervision and procuratorial authorities in duty-related crimes,institutional improvements can be made by introducing special coordination procedures,improving the coordination mechanism for guilty plea leniency,clarifying regulatory procedures for early intervention,and delineating the respective jurisdictional scopes of the two authorities,thereby strengthening the effectiveness of the system.
