数据爬取的反不正当竞争法规制范式研究

摘　　要：【目的】重点分析我国司法实践中数据权益归属判定不明、竞争行为正当性认定标准模糊和裁判论证路径缺失等问题,以期为反不正当竞争法规制数据爬取问题提供解决思路。【方法】通过案例分析、理论研究的方式,对国内外出现的数据爬取案例进行梳理,对学界目前存在的理论进行分析。【结果】数据确权并非规制数据爬取行为的恰当方式,通过反不正当竞争法范式规制数据爬取行为,有利于平衡数据持有人的经济利益与数字产业发展的需求。【结论】适用《反不正当竞争法》一般条款规制数据爬取行为可能导致条款的滥用,而“互联网专条”则存在无法完全评价数据爬取行为的问题,应当谨慎适用《反不正当竞争法》一般条款,在《反不正当竞争法》第12条第1款第3项后增设“未经其他经营者允许,通过数据爬取等途径获取他人一定积累的具有商业价值的数据,导致其他经营者的相关市场受到不合理损害”的行为。[Purposes]To address unclear attribution of data rights and interests,ambiguous standards for determining the legitimacy of competitive behaviours,and the lack of adjudication path ways in China′s judicial practice,this study proposes solution for regulating data crawling under competition law.[Meth⁃ods]Through case studies and theoretical analysis,domestic and international data-crawling cases are examined,and existing academic theories are analyzed.[Findings]Data right confirmation is not an ap⁃propriate way to regulate data crawling behavior.Regulating data crawling behavior through the para⁃digm of anti-unfair competition law is conducive to balancing the economic interests of data holders and the needs of digital industry development.[Conclusions]The application of the general provisions of the"Anti-Unfair Competition Law"to regulate data crawling may lead to the abuse of the provisions,while the"Internet Article"has the problem of not fully evaluating data crawling behavior.The general provi⁃sions of the"Anti-Unfair Competition Law"should be applied with caution.After the third section of Ar⁃ticle 12,paragraph 1,of the"Anti-Unfair Competition Law,"the act of"without the permission of other op⁃erators,obtaining certain commercially valuable data accumulated by others through data crawling and other means,resulting in unreasonable damage to the relevant market of other operators"should be added.
