摘  要:【目的】虚拟数字人在著作权领域定位模糊,其著作权保护面临多重法律困境,应当从“作品表达具有整体性”角度进行思考,以期为保护创作者权益、推动虚拟数字人技术的良性发展提供参考。【方法】运用比较分析与案例分析的方法,分别从理论和现实层面对比拆分保护模式和整体保护模式。【结果】拆分保护模式作为类型限定保护范围的产物,既在理论上与2020年《著作权法》修订后的各个环节相冲突,又在现实层面扰乱了著作权法保护范式与商业实践,应当予以摒弃。【结论】明确作品保护范围由独创性表达决定,而非表达形式所限定。针对虚拟数字人等复合型作品的保护问题,应当坚持整体保护观的侵权判定方式。[Purposes]The positioning of virtual digital humans in the field of copyright is vague,and the pro⁃tection of copyright faces multiple legal dilemmas.It should be considered from the perspective of“the integ⁃rity of work expression”to provide a reference for protecting the rights and interests of creators and promoting the healthy development of virtual digital human technology.[Methods]Using comparative analysis and case analysis methods,the theoretical and practical levels of the split protection mode and the overall protection mode are compared respectively.[Findings]The split protection mode,as a product of the type-limited pro⁃tection scope,conflicts with various links after the revision of the“Copyright Law”in 2020 in theory,and dis⁃rupts the copyright law protection paradigm and business practice in reality,and thus should be abandoned.[Conclusions]It is clear that the scope of work protection is determined by original expression rather than limited by the form of expression.For the protection of compound works such as virtual digital humans,the in⁃fringement determination method of the overall protection view should be adhered to.
