摘  要:【目的】为了克服诉讼方式解决知识产权纠纷带来的局限性,探索如何通过仲裁、调解等非诉方式更好更快地解决知识产权纠纷。【方法】通过总结归纳、数据分析的方法对诉讼方式解决知识产权纠纷的局限性进行分析。【结果】知识产权纠纷有着专业性强、利益多元化和对时效性要求高等特点,目前的诉讼方式解决知识产权纠纷存在局限性,如缺乏专业人员、审理期限较长、不具有保密性等。而仲裁、调解等非诉方式因其程序灵活、解决期限较短和兼具保密性、弱对抗性,更适合解决知识产权纠纷。【结论】目前的仲裁、调解机制尚存不足之处,亟待改进。对于仲裁而言,需要扩充仲裁的适用范围,加大对仲裁的制度建设和宣传;对于调解而言,在行政调解中要严格依照法定程序,并设立专门的知识产权调解后的司法确认程序。[Purposes]Better and faster resolution of intellectual property disputes through arbitration and mediation,so as to overcome the limitations imposed by litigation.[Methods]The limitations of the litiga⁃tion approach are analyzed through the methods of summary induction and data analysis.[Findings]In⁃tellectual property disputes are characterized by strong professionalism,diversified interests and high re⁃quirements for timeliness,and there are limitations in the current litigation mode of resolving intellectual property disputes,such as a lack of professionals,a longer trial period and a lack of confidentiality.How⁃ever,non-litigation methods such as arbitration and mediation are more suitable for resolving intellec⁃tual property disputes due to their flexible procedures,shorter settlement period,confidentiality and weak confrontation.[Conclusions]The current arbitration and mediation methods also have their own shortcomings that need to be optimized,for arbitration,it is necessary to expand the scope of application of arbitration,increase the construction of the arbitration system and publicity;for mediation,the administra⁃tive mediation should be strictly in accordance with the statutory procedures,and it is also necessary to set up a special intellectual property rights mediation procedure after the judicial confirmation of the procedure.
