摘  要:目前,我国网络购物发展迅速,给公众生活带来了极大便利,但由于法律规定的不完善以及执法过程中监管不严导致虚假宣传、大数据“杀熟”、商品质量风险等问题也屡见不鲜,使我国网络消费者知情权频频遭受侵害。当下存在网络经营者虚假宣传、网络平台审核不到位、大数据“杀熟”、滥用格式条款等问题,其主要的形成原因包括信息披露制度不完备、跨区域跨部门治理力度不足、平台监管责任不落实、网络购物虚拟性为非法行为提供了便利等。通过完善商品信息披露制度、健全大数据“杀熟”的规制措施、发挥行政监管和社会组织的作用,提高我国网络消费者知情权的法律保护水平。At present,the rapid growth of online shopping in China has significantly enhanced public convenience.However,due to inadequate legal provisions and lax regulatory enforcement,issues such as false advertising,big data“price discrimination,”and product quality risks have become increasingly prevalent,resulting in frequent infringements of online consumers’right to know in China.Current issues include false advertising by online operators,insufficient platform review mechanisms,big data“price discrimination,”and the misuse of standard terms.The primary causes include inadequate information disclosure systems,insufficient cross-regional and cross-departmental governance,unfulfilled platform regulatory responsibilities,and the virtual nature of online shopping facilitating illegal activities.By improving the commodity information disclosure system,strengthening regulatory measures against big data“price discrimination,”and leveraging the roles of administrative oversight and social organizations,the level of legal protection for online consumers’right to know in China can be enhanced.
