我国移民管理法治建设的思考  

Reflections on the Legal System Construction of Immigration Management in China

摘　　要：随着全球化进程的加速,移民管理日益成为各国的重要议题。当前,指导我国移民管理的主要法律包括《中华人民共和国出境入境管理法》《外国人入境出境管理法》及相关配套法规。存在的问题:移民管理立法碎片化;移民管理法律法规不完善;立法目的局限,管理理念落后;移民权益保障缺失;违法成本低。建议从立法、执法等方面寻求对策,我国亟待通过健全法律体系、建立统一的执法标准、加强法制宣传、加强执法水平提升等方式,使移民管理工作高效、有序地开展。通过这些措施,既能切实维护国家出入境秩序、保障移民基本权益,又能促进社会和谐稳定。With the acceleration of globalization,migration management has become an important issue in many countries.Currently,the major laws guiding China’s immigration management are the Exit and Entry Administration Law of the People’s Republic of China,the Law of the People’s Republic of China on the Administration of the Entry and Exit of Foreigners,and relevant supporting regulations.Existing problems include:the fragmentation of immigration management legislation;the imperfection of immigration management laws and regulations;the narrow legislative purpose and outdated management concepts;the absence of protection for immigrants’rights and interests;the low cost of law violations.It is recommended to seek solutions from such aspects as legislation and law enforcement.Specifically,there is an urgent need in China to improve the legal system,establish unified law enforcement standards,strengthen legal publicity,and enhance law enforcement capabilities,so that immigration management can be carried out efficiently and in an orderly manner.With the help of the countermeasures proposed above,the entry and exit order in China is expected to be effectively maintained to safeguard the basic rights and interests of immigrants,and social harmony and stability can also be promoted.
