论共同正犯的规范塑造

摘　　要：在实行行为规范化、实质化的浪潮下,德日刑法学界提出诸多理论来限定共同正犯的范围,然而至今无法达成统一性认识;我国刑法的通说主张在量刑时按照行为的社会危害性大小来认定共同正犯在共同犯罪中所起的作用,然而社会危害性并非一个规范概念,其无法承担限定共同正犯的功能。从规范意义上看,共同正犯应是塑造规范意义的表达,其归责对象是构成要件的实现,限定共同正犯成立的标准是共同塑造性支配:对于实施部分构成要件的行为者,恒为正犯,包括共同正犯;对于未实施实行行为的共谋者,如果共谋者的地位或者谋议行为支配了构成要件的实现,或者共谋者行为的不法及罪责程度相当于实行行为的,皆应认定为共同正犯。In the implementation of behavior standardization and substantive wave,German and Japanese criminal law circles put forward many theories to limit the scope of joint principal crime,but so far cannot reach a unity understanding.The general theory of Chinese criminal law advocates that the role of joint principal offender in joint crime should be determined according to the size of the social harmfulness of the behavior when sentencing.However,social harmfulness is not a normative concept,which cannot assume the function of limiting joint principal offender.From the normative sense,joint principal crime should be the expression of shaping normative meaning.The object of imputation is the realization of constituent elements.The standard to define the establishment of joint principal offender is joint plastic domination.As for the act constituting an element of the implementation part,it is always a principal offender,including a joint principal offender.For the conspirators who have not carried out the performing act,if the status of the conspirators or the deliberative act dominates the realization of the constituent elements,or if the degree of wrongfulness and culpability of the conspirators’acts is equivalent to the performing act,they should be identified as joint principal offenders.
