民法典基本原则的课程思政案例教学探索

摘　　要：课程思政是解决法学教育重“器”轻“道”的有效途径。因民法典基础性法律和民法核心课的地位,民法教学应该成为法学教育课程思政教学的主阵地。民法内容庞杂,特以民法典基本原则的课程思政教学为例,充分挖掘与民法典基本原则具有高度一致性的弘扬社会主义核心价值观中的思政因素,点明它们共同的道德基础和价值取向,同时引入弘扬社会主义核心价值观的典型案例,讲明案例背后的法律规范与价值规范的一致性,探索民法典基本原则、社会主义核心价值观及其案例有机融合的案例教学法,才能起到课程思政良好育人效果。Curriculum ideological and political education is an effective way to solve the problem that legal education attaches more importance to"instrument"than"Tao."Because of the status of the basic law of the civil code and the core course of civil law,the teaching of civil law should become the main position of ideological and political teaching in the course of legal education.The content of civil law is complex.This paper takes the course ideological and political teaching of the basic principles of the civil code as an example,fully excavates the ideological and political factors in the promotion of socialist core values that are highly consistent with the basic principles of the civil code,and points out their common moral basis and value orientation.At the same time,it introduces typical cases of promoting socialist core values,explains the consistency of legal norms and value norms behind the cases,and explores the case teaching method of organic integration of the basic principles of the civil code,socialist core values and case codes,so as to play a good educational effect of course ideological and political education.
