摘  要:奢侈品表征了高品质、高价格、高创意等属性,具有稀缺性、高品牌附加价值与特定的消费群体,市场上普遍采用选择性分销模式分销产品。近年来,美欧等国家和地区对奢侈品行业的执法、司法实践涵盖了横向垄断协议、转售价格维持、纵向非价格限制、滥用市场支配地位、经营者集中审查等方面。相比而言,我国奢侈品市场的反垄断案件较少,但其体现出较大的潜在垄断风险,包括双重分销的横向垄断风险、选择性分销的排他性风险、滥用市场支配地位的垄断风险和企业并购的垄断风险。我国应强化奢侈品行业的反垄断法规制,将奢侈品市场界定为区别于大众市场的独特市场,明确奢侈品行业双重分销和选择性分销的反垄断分析框架,关注奢侈品行业滥用市场支配地位行为,细化奢侈品行业经营者集中审查的考虑因素,同时建立行业调查制度,强化个案执法,发挥反垄断法的威慑作用。Luxury goods represent attributes such as high quality,high price,and high creativity,with scarcity,high brand added value,and specific consumer groups.Selective distribution models are commonly used in the market to distribute products.In recent years,law enforcement and judicial practices in the luxury goods industry in countries and regions such as the United States and Europe have covered horizontal monopoly agreements,resale price maintenance,vertical non price restrictions,abuse of market dominance,and concentration reviews of operators.Compared to these regions,there are few anti-monopoly cases in China's luxury goods market,yet there are significant potential monopoly risks,including horizontal monopoly risks of dual distribution,exclusive risks of selective distribution,monopoly risks of abuse of market dominance,and monopoly risks of corporate mergers and acquisitions.China should strengthen the anti-monopoly regulation of the luxury goods industry,define the luxury goods market as a unique market distinct from the mass market,clarify the anti-monopoly analysis framework for dual distribution and selective distribution in the luxury goods industry,pay attention to the abuse of market dominance in the luxury goods industry,refine the considerations for the concentration review of luxury goods industry operators,establish an industry investigation system,strengthen individual case law enforcement,and exert the deterrent effect of anti-monopoly law.
