摘　　要：监察法文本中虽无“处置权”的表述,且涉及“处置”的条款众多,但基于法释义学的分析,可以厘清立法中两种不同“处置”概念的关系和“证立处置权”这一法律概念。监督权、调查权和处置权各自承载不同的功能,且具有互补性和不可替代性,“三权”一体共同塑造了完整的监察权形态。作为法定职权的处置权,在创设方面应当遵循法律保留原则。处置权是监督权与调查权的后位性权力,具有一定的强制执行力。监察委员会的政治与法律双重属性特征,决定了处置权兼具政治权力与法律权力属性。与监督权和调查权相比,处置权在属性特征上还体现为其兼具实体权力与程序权力、判断权与监督权的双重属性。Although the term"disposition power"is not explicitly stated in the text of the Supervision Law,and there are numerous provisions involving"disposition,"a legal-interpretive analysis can clarify the relationship between the two different concepts of"disposition"in the legislation and the legal concept of"justification for disposition power."The powers of supervision,investigation,and disposition each carry distinct functions,and they are complementary and irreplaceable.The integration of these"three powers"jointly shapes the complete form of supervisory power.As a statutory power,the disposition power should follow the principle of legal reservation in its establishment.The disposition power is a subsequent power to the powers of supervision and investigation and has a certain degree of enforcement power.The dual characteristics of political and legal attributes of the Supervisory Commission determine that the disposition power has both the attributes of political power and legal power.Compared with the powers of supervision and investigation,the disposition power also reflects its dual attributes of being both a substantive power and a procedural power,as well as a power of judgment and supervision.
