摘　　要：平台涉隐私数据垄断行为层出不穷:在数据收集场景下包括构成剥削性滥用的强制收集、构成共谋的过度收集以及经营者集中后的过度收集;在数据处理场景下包括构成价格歧视和行为歧视的不当利用、构成排他性滥用的数据封锁、构成共谋的不当共享。科学认定平台涉隐私数据垄断行为,应当遵循谦抑性原则,兼顾多元价值目标。在平台涉隐私数据垄断行为的认定过程中,仍存在相关市场和市场支配地位难以认定、隐私损害难以量化和评估、合并审查标准不明等困境。对此,应建立多边市场界定机制、细化市场支配地位的认定方法、创建隐私损害分析工具、明确合并审查启动标准及完善隐私损害评估机制。Monopoly behaviors of platforms involving privacy data are emerging continuously.In the context of data collection,these behaviors include compulsory collection that constitutes exploitative abuse,excessive collection that constitutes collusion,and excessive collection following business concentration.In the context of data processing,these behaviors include improper utilization that constitutes price discrimination and behavioral discrimination,data blockade that constitutes exclusive abuse,and improper sharing that constitutes collusion.To scientifically identify platform monopoly behaviors involving privacy data,the principle of modesty and restraint should be followed,and multiple value objectives should be taken into account.However,in the process of identifying such behaviors,there are still dilemmas such as the difficulty in defining the relevant market and market dominance,the challenge of quantifying and assessing privacy damage,and the lack of clear standards for merger review.To address these issues,it is necessary to establish a mechanism for defining multilateral markets,refine the methods for identifying market dominance,create tools for analyzing privacy damage,clarify the standards for initiating merger reviews,and improve the mechanisms for assessing privacy damage.
