加蓬劳动法律体系概述与劳工争议风险浅析

摘　　要：随着时间变迁,加蓬劳动法经历了从习惯法到殖民地法再到独立后本土法的演变。如今,加蓬法律体系趋于多元化发展。近年来,加蓬政府不断修订劳动法,由此改善外商投资环境,以促进当地经济发展并稳定民生就业。由于深受法国司法体系影响,加蓬劳动法律体系更倾向于保护劳动者权益。司法实践中,当地法院判决支持劳工诉求的争议纠纷更是屡见不鲜。在加蓬投资的国际石油企业应掌握加蓬劳动法律体系概况,尤其是与雇佣关系相关的政策法规,并结合法律和案例实践,积极防范和规避对加蓬投资的劳工争议或风险。Over time,Gabon's labor law has evolved from customary law to colonial law to indigenous law after the independence.Today,Gabon's legal system is more diversified.In recent years,the Gabonese government has continuously amended the labor law to improve the environment for foreign investment in order to promote economic development and stabilize local livelihood and employment.Heavily influenced by the French legal system,Gabon's labor law system is more inclined to protect workers'rights and interests.In judicial practice,it is common for local courts to adjudicate in favor of labor claims in disputes.International oil companies investing in Gabon should have an overview of its labor law system,especially the policies and regulations related to employment relations,and actively prevent and avoid labor disputes or risks of investment in Gabon in accordance with the law and case practice.
