马克思主义正义思想同中国传统正义观的彼此契合和相互成就

摘　　要：中国传统公平正义观并不逊于西方古代公平正义思想的发展水平,其中蕴含着丰富的关于正义的思想资源,与马克思主义正义思想相互结合后可以帮助我们建构中国现代正义价值文明。中国传统正义观与马克思主义正义思想在“实践性”“唯物性”与“理想性”等方面存在着契合、相通和先在的共同性基础。基于彼此契合的前提,中国传统正义观为马克思主义正义思想中国化提供了接受认知的连接介质、认可理解的思维模式、创新发展的文化语境;同时马克思主义正义思想也弥补了中国传统正义观的制度正义缺陷,并对其“差别思想”、价值目标的现代转型提供了指引,从而实现了二者从相互契合到相互成就的结合。基于二者的“结合-建构”逻辑和对西方现代化反思的“批判-建构”逻辑,中国现代正义价值文明应该具有大群体本位、共享、共存的三层内涵。The view of justice in Chinese traditional philosophy is compatible and complementary with Marxist thoughts on justice in terms of practicality,materiality,and ideality.It establishes the bridge,sets the mindset,and creates the cultural matrix for Chinese people to conceive,contemplate,and develop Marxist thoughts on justice.By contrast,Marxist thoughts on justice also provide the standpoint,methodology,and historical perspectives to dialectically review,select,and utilize the pith and marrow of the Chinese traditional view of justice for its further modernization.Integrating the two intellectual traditions,a just,modern form of Chinese civilization should center around building a large collaborative,sharing,and mutually benefiting community.
