国家涉外法治建设中的香港角色探析

摘　　要：涉外法治是中国特色社会主义法治体系的重要组成部分,其重要性日益凸显。香港特区涉外法治是“一国两制”制度体系和国家涉外法治的重要组成部分。香港地区涉外法治体系总体上与其地位相符并较为完善,形成了自身突出的法治优势,也成为香港地区助力国家涉外法治建设的独特优势。一直以来,香港地区凭借其独特优势在国家涉外立法、执法司法、法律服务、参与全球治理和涉外法治人才培养等方面为国家涉外法治建设积极贡献力量,发挥着重要作用,包括探索容错的试点作用、内联外通的桥梁作用、转化缓冲的衔接作用、协作配合的协同作用等。面对国家涉外法治建设重任,未来需要进一步统筹协调香港特区涉外法治建设,更好发挥香港地区的作用。The foreign-related rule of law is an important part of the socialist rule of law system with Chinese characteristics,and its importance is becoming increasingly prominent.The foreign-related rule of law in the Hong Kong Special Administrative Region is an important part of the“one country,two systems”institutional system and the country's foreign-related rule of law.The foreign-related rule of law system in Hong Kong is generally in line with its status and well-developed,showing outstanding advantages in the rule of law which have become the unique advantages of Hong Kong in contributing to the country's construction of foreignrelated rule of law.Hong Kong has all along contributed to the country's construction of the foreign-related rule of law and played an important role in such aspects as the country's foreign-related legislation,law enforcement and justice,legal services,participation in global governance and cultivation of foreign-related rule of law talents by virtue of its unique advantages.These roles include the pilot role for exploring fault tolerance,the bridging role for internal connection and external communication,the connection role for transformation and buffering,and the coordination role.Facing the important task of the country's construction of the foreign-related rule of law,it is necessary to further coordinate the construction of the foreign-related rule of law in the Hong Kong Special Administrative Region to give better play to the role of Hong Kong.
