摘　　要：香港地区国家安全犯罪案件的刑罚裁量是特区全面准确贯彻实施《香港国安法》的关键环节,也是依法治港的重要实践。从已决相关判例来看,香港特区法官在“法定刑档次选择”和“减轻处罚”情节的适用问题上遭遇挑战。其原因主要是《香港国安法》作为中央立法,在量刑理念、技术及规则等方面与香港特区法官长期遵循的普通法裁判惯习存在差异。针对此问题,香港特区法院秉持司法克制主义,将立法者的真实原意作为裁判依据,阐明了《香港国安法》与香港地区本地普通法的关系,明晰了《香港国安法》与内地《刑法》的界限关系,确保了国安犯罪被告人的公正处遇,初步实现了香港地区国安犯罪刑罚裁量的规范化构建。The sentencing of crimes against national security in Hong Kong region is a key link for the special administrative region to comprehensively and accurately implement the National Security Law for Hong Kong region and an important practice of governing Hong Kong region in accordance with the law.Judging from the related judgments,judges in the Hong Kong Special Administrative Region have encountered challenges in the selection of legal sentencing grades and the application of“mitigating punishment”circumstances.The main reason is that as central legislation,the National Security Law for Hong Kong differs in sentencing concepts,techniques and rules from the common law adjudication habits long followed by judges in the Hong Kong Special Administrative Region.In response to this problem,the courts in the Hong Kong Special Administrative Region uphold judicial restraint,take the true intention of the legislators as the basis for adjudication,clarify the relationship between the National Security Law for Hong Kong and the local common law in Hong Kong,define the boundary relationship between the National Security Law for Hong Kong and the Criminal Law of the Mainland,ensuring the fair treatment of defendants charged with national security crimes and initially realizing the standardized construction of sentencing for crimes against national security in Hong Kong region.
