摘　　要：当前学界对民族团结进步地方立法的实施路径存在诸多争议,症结在于对其实施逻辑认识不到位。虽然现有立法已关注到行政主体以外的社会主体参与,但实施主体范围及其“权”的配置尚不明确、实施内容存在照搬相关法律或政策的现象、政府及相关部门的实施方式以及法律责任的规定都还有待完善。通过与“司法适用导向”和“行政执法导向”立法的比较,可以明确民族团结进步地方立法作为“社会参与导向”立法的实施逻辑。在立法中确保全社会多元主体的参与、让政府及相关部门更多承担服务功能、强化规范的引导作用并合理设置法律责任,才能通过立法的实施真正实现民族团结进步事业的促进。There are currently many disputes in the academia regarding the implementation paths of local legislation for national unity and progress.The core of the problem lies in the insufficient understanding of its implementation logic.Although existing legislation has recognized the participation of social entities beyond administrative bodies,the scope of implementing entities and the allocation of their“quan”are still unclear.There are also instances of simply copying related laws or policies in the implementation content,and the methods of implementation by the government and relevant departments,as well as the provisions on legal responsibilities,still need improvement.By comparing with the legislation oriented towards“judicial application”and“administrative law enforcement”,the implementation logic of local legislation on national unity and progress as“social participation-oriented”legislation can be clarified.Only by ensuring the participation of multiple subjects in the whole society in the legislation,making the government and relevant departments undertake more service functions,strengthening the guiding role of norms and reasonably setting legal responsibilities can the promotion of the cause of national unity and progress be truly achieved through the implementation of legislation.
