数据从属性下新就业形态劳动者权益保障研究

摘　　要：纾解新就业形态劳动者权益保障不足困境的关键在于劳动者主体身份的确认。数字经济下新就业形态劳动用工“项目化”、组织“平台化”、管理“算法化”,使得新就业形态劳动者难以在传统从属性理论中寻找到救济路径。但新就业形态劳动者对数据生产资料的强依附性和平台算法治理的强控制性使得新就业形态劳动者形成新的从属性特征,辛茨海默也曾借助马克思主义理论视角指出“对生产资料的所有权带来了依附性”。有鉴于此,借助马克思主义劳动价值论的理论视角,以数据生产资料的占有为基础,算法控制为表征,数据要素分配为结果,构建“数据从属性”的劳动关系认定标准,强化劳动保护,有利于纾解新就业形态劳动者权益保障的困境。The key to alleviate the dilemma of insufficient protection of the rights and interests of workers in new forms of employment lies in the confirmation of the identity of the workers as the main body.Under the digital economy,the“project-based”labor employment,“platform-based”organization,and“algorithmic”management of new forms of employment make it difficult for workers to find relief paths in traditional attribute theory.However,the strong dependence of workers in new forms of employment on digital means of production and the strong control of platform algorithm governance have led to the formation of new subordinate characteristics for workers in new forms of employment.Hugo Sinzheimer also pointed out from the perspective of Marxist theory that“ownership of means of production brings dependence”.In view of this,with the theoretical perspective of Marxist labor theory of value,based on the possession of digital means of production,digital control as a representation,and data element distribution as a result,constructing a“digital subordinate attribute”labor relationship recognition standard and innovative labor protection is conducive to alleviating the dilemma of protecting the rights and interests of workers in new forms of employment.
