论世界法学版图的重绘

摘　　要：绘制世界法学版图,有助于为中国法学提供坐标与参照。根据世界法学的演进历程,可以绘制出世界法学版图的三个历史版本:针对两千年前的世界法学格局,可以绘制出“1.0版本”的世界法学版图;针对一千年前的世界法学格局,可以绘制出“2.0版本”的世界法学版图;针对一百年前的世界法学格局,可以绘制出“3.0版本”的世界法学版图。自“3.0版本”的世界法学版图在19世纪末20世纪初形成以来,世界法学格局已经发生了急剧而深刻的变迁,主要体现为社会主义法学的兴起、西方法学地方性的凸显以及世界法学多元化的显现,这三种趋势的汇合,为重绘“4.0版本”的世界法学版图提供了现实依据。站在中国立场上重绘世界法学版图,有必要在中西古今之间,推动中国古典法学的时代化与西方法学的中国化,在此基础上实现中国法学的世界化,以之彰明“4.0版本”的世界法学版图中的中国板块。Drawing a global legal map helps provide a framework of reference and coordinates for Chinese legal science.Based on the evolutionary process of global legal science,three historical versions of the global legal science map can be identified:With reference to the global legal science framework of two thousand years ago,the“1.0 version”of the global legal science map can be constructed;Based on the global legal landscape of a thousand years ago,the“2.0 version”of the global legal map can be drawn;Based on the global legal landscape of a hundred years ago,the“3.0 version”of the global legal map can be drawn.Since the emergence of the“3.0 version”of the global legal landscape in the late 19th and early 20th centuries,the global legal framework has undergone rapid and profound changes in over a hundred years,mainly reflected in the rise of socialist legal science,the increasing prominence of localized western legal science,and the emergence of diversified global legal science.The convergence of these three trends provides a practical basis for redrawing the“4.0 version”of the global legal landscape.From a Chinese perspective,it is imperative to redraw the global legal map and promote the modernization of Chinese classical law and the sinicization of western law,bridging ancient and modern legal traditions in both China and the west.On this basis,it is necessary to achieve the internationalization of Chinese law and make it clear the China section in the“4.0 version”of the global legal map.
