摘　　要：发展中国家谋求获得公平合理待遇,一直是第二次世界大战后国际经济法发展的一大主题。过去,这一问题只存在于发达国家与发展中国家之间。时至当下,中国发展成为世界经济大国之后,也面临着如何公平对待其他弱小发展中国家的问题。中国在合作共赢原则下践行“实力界定收益-”分配逻辑,正展现了本质上有别于发达国家的另一种样态。对于“实力界定收益-”中国逻辑本身及其适用程度的理解,不能仅按照认知主义的“适当性选择”模式简单地将之归为中国基于自身观念所采取的一种利他行为,而是要同时关注理性主义“结果性选择”模式对其利益动因的解释。在构建“一带一路”国际经济法律制度的过程中,中国在更大程度上对参加共建的发展中国家践行“实力界定收益-”分配逻辑,从道义层面更好地彰显其源于中华优秀传统文化的正确义利观,也显现了其符合中国整体利益和长远利益的自利性。The pursuit of fair and reasonable treatment by developing countries has been a major theme in the development of international economic law since the Second World War.Previously,this issue existed solely between developed and developing countries.Nowadays,as China has risen to become a major economic power in the world,it also faces the challenge of how to treat other weaker developing countries fairly.In this regard,China's practice of the"capability-defines-benefits-"distribution logic under the principle of mutual benefit and win-win cooperation demonstrates a different approach from that of developed countries in essence.The understanding of China's"capability-defines-benefits-"logic itself and its applicability should not be simply attributed to an altruistic behavior based on Chinese perceptions,following the cognitivism"logic of appropriateness".Instead,it is crucial to also consider the rationalism"logic of consequences"in explaining its underlying interests.In the process of building the international economic legal system of the Belt and Road Initiative,China has more extensively applied the"capability-defines-benefits-"distribution logic to participating developing countries,which not only reflects its correct view of righteousness and benefit rooted in Chinese excellent traditional culture on a moral basis,but also demonstrates its self-interest aligning with China's overall and long-term interests in terms of motives.
