生态环境法典编纂中的“认购碳汇”替代性修复制度设计

摘　　要：“认购碳汇”替代性修复制度已经在司法实践中广泛运用,成为“双碳”目标下生态司法实践创新的典范。随着这一制度实践探索的逐步深入,立法供给不足的问题日渐凸显,将其纳入生态环境法典之中则是上佳之选。在这一进程中,应当及时总结“认购碳汇”替代性修复的制度经验,充分论证其立法必要性,明确其在生态环境法典中的制度设计路径;应当理顺其入典的内外部逻辑,即在内部逻辑上处理好责任编内“认购碳汇”同法典其他编章的关系,在外部逻辑上处理好生态环境法典编纂与其他相关立法的衔接;应当以契合生态环境法典系统化体系化为旨趣,以列举式立法的形式在生态环境责任编中形成“实体规则+衔接规则”的“认购碳汇”替代性修复制度规范,从而在立法上实现其法律体系的融贯。The alternative remediation system of“carbon sink subscription”has been widely applied in judicial practice,and has become a model of ecological judicial practice innovation under the“dual-carbon”goal.With the gradual deepening of the practice and exploration of this system,the problem of insufficient legislative framework has become increasingly prominent,and the best solution is to incorporate the remediation system into the environment code.In this process,the institutional experience of“carbon sink subscription”alternative remediation shall be summarised in time,fully demonstrate its legislative necessity,and clarify its institutional design path in the environment code;The internal and external logic of its entry into the code should be straightened out,the relationship between“carbon sink subscription”in the responsibility code and other chapters of the code should be handled properly in the internal logic,and the connection between the codification of environment code and other relevant legislation should be handled properly in the external logic.It is necessary to form the“entity rule plus cohesion rule”alternative remediation system of“carbon sink subscription”in the environmental responsibility code in the form of enumeration legislation,so as to achieve the integration of its legal system in legislation.
