生态环境法典体系化历史中的法律渊源

摘　　要：为保持生态环境法典的安定性、简洁性、融贯性,生态环境保护领域中功能性强、过于细密的、价值理念悬殊的规范应由单行法另行规定。为保持法典的开放性,未来的新型单项立法不可避免,单项立法应在生态环境法典框架下再出发。指导案例有效地发挥着生态环境法律辅助作用,生态环境法应回归混合法型的中国法律传统。生态环境法典颁布之后,地方立法应在中央立法指导下再协同,生态环境民间规范则构成补充性规范。生态环境法典编纂应当摒弃对完备性过度追求的负担,立足于生态文明建设的历史新起点,提炼、纂修、汇编既有规范,同时为单行法、地方立法、民间习惯法留下接口,并允许判例填充法典留下的空隙。生态环境法典需要面向未来,不断调适与其他法律渊源的关系,适时自我更新。In order to maintain the stability,conciseness and coherence of the eco-environmental code,the norms with strong functionality,being overly detailed and having disparate value concepts in the field of eco-environmental protection should be separately stipulated by separate laws.To maintain the openness of the code,new individual legislations in the future are inevitable,and individual legislations should start anew under the framework of the eco-environmental code.Guiding cases effectively play an auxiliary role in eco-environmental laws,and the eco-environmental law should return to the Chinese legal tradition of the mixed-law type.After the promulgation of the eco-environmental code,local legislations should be coordinated again under the guidance of central legislations,and folk norms in the eco-environmental field constitute supplementary norms.The compilation of the eco-environmental code should abandon the burden of excessive pursuit of completeness,base itself on the new historical starting point of the construction of ecological civilization,extract,revise and compile the existing norms,leave interfaces for separate laws,local legislations and folk customary laws at the same time,and allow judicial precedents to fill the gaps left by the code.The eco-environmental code needs to face the future,continuously adjust its relationship with other legal sources and update itself in a timely manner.
