摘 要:领域法的观点难以否认经济法、环境法等法律体系的部门行政法属性。领域法的任务导向和问题意识决定了其无法采用传统教义学的核心概念作为自身的体系化工具。指向个人利益的权利概念难以契合领域法的公共利益本位,应当主要在客观价值秩序的意义上使用。领域法在构造上以政策工具为主要内容。政策工具关注行政活动方式的功能和目的等实体要素,与行为形式论存在根本差异,无法进行概念演绎,这导致领域法难以建立起一种概念演绎体系。领域法无法采用教义学形态,这是领域法难以编纂为体系性法典的根本原因。领域法的法典编纂是一种汇编型法典,其总则部分没有核心概念,应当主要规定基本原则、管理体制和一些比较重要的政策工具。The perspective of domain law can hardly deny the sectoral administrative law attributes of economic law,environmental law and other legal systems.The task-orientation and problem-consciousness of the domain law determines that it cannot adopt the core concepts of traditional doctrines as its own systematization tools.The concept of rights,which points to individual interests,is difficult to fit into the public interest orientation of domain law,and should be used mainly in the sense of objective value order.Domain law is constructed with policy tools as its main content.Fundamentally different from behavioral form theory,policy tools focus on the function and purpose of administrative activities and other substantive elements,and are unable to conduct conceptual deduction,which made the domain law difficult to establish a conceptual deduction system.The inability of domain law to adopt a doctrinal form is the fundamental reason why it is difficult to codify domain law as a systematic code.The codification of domain law is a compilation-type code,the general part of which has no core concepts and should mainly provide for the basic principles,the regulatory system and some more important policy tools.
