施工合同无效后参照工程价款约定折价补偿问题研究

摘　　要：为解决施工合同无效后工程价款的纠纷问题,《民法典》793条提出“可以参照合同关于工程价款约定折价补偿”。但是,工程价款约定的内容繁杂,对于能够参照的范围也存在较多争议。通过将工程价款约定类型化为计价约定、调整约定和支付约定3个方面,结合司法判例,系统研究上述约定折价补偿的参照范围,并对常见的争议问题进行了探析。To address disputes over engineering price payments following the invalidation of construction contracts,Article 793 of the Civil Code states that"price offset compensation may refer to the engineering price agreements in the contract."However,the complexity of engineering price agreements has led to considerable debate regarding the scope of reference.Engineering price agreements are categorized into three aspects:pricing agreements,adjustment agreements,and payment agreements.Based on judicial precedents,the scope of reference for price offset compensation is systematically analyzed,along with an exploration of common contentious issues.
