统筹视角下长江流域管理体制困境纾解

摘　　要：长江流域是人与自然和谐共生的重要场域。随着协同治理理论的广泛运用,我国长江流域管理体制历经多个阶段演变,在统筹视角下建立了流域协调机制。然而与黄河流域统筹协调机制进行对比,其管理体制发展仍面临多重挑战,包括管理体制建设未贯彻“生态优先、绿色发展”原则,要素间、区域间管理体制的统筹发展仍陷条块分割等问题。对此,有必要出台专门的流域管理立法,增强生态优先和绿色发展的法治化;在明确流域管理体制优化方向的基础上,纵向上分阶段完善流域全要素管理体制建设,横向上明确地方协调机构之间的职能配置。The Yangtze River Basin is an important field for the harmonious coexistence between man and nature.With the widespread application of collaborative governance theory,the management system of the Yangtze River basin in China has evolved through several stages,and the watershed coordination mechanism has been established from the perspective of overall planning.However,by comparing it with the coordination mechanism of the Yellow River basin,the development of the management system from the perspective of coordination is still facing multiple challenges,Including the failure to implement the principle of“ecological priority and green development”in the construction of management systems,the overall development of management systems between elements and regions still faces problems such as fragmentation.Therefore,it is necessary to introduce special legislation on watershed management to enhance the rule of law of ecological priority and green development.On the basis of clarifying the optimization direction of the watershed management system,the construction of the total factor management system of the watershed should be improved in the vertical stages,and the functional allocation between local coordination agencies should be defined in the horizontal way.
