汾河流域横向生态保护补偿机制的困境检视与进路完善

摘　　要：流域横向生态保护补偿机制的构建能够有效整合流域内不同地区的生态资源,促进流域内生态平衡与互惠共享。聚焦黄河流域高质量发展的历史定位,山西省开展了汾河流域横向生态补偿机制试点工作。但由于山西省尚处于初步探索阶段,存在法律规范供给不足,市场化、多元化补偿缺乏,保障机制阙如等现实困境,亟待进行理论探索。结合试点实施状况,借鉴其他地区实践经验,从完善以地方性法规为基础、政府规范性文件为补充的规范体系,构建以政府主导、市场辅助的多元化补偿方式,同时加强监督机制、社会参与机制与激励机制等保障机制三个层面提出进路完善,以期促进山西省汾河流域横向生态保护补偿试点工作的深入开展,保障汾河流域生态环境的健康发展。The construction of horizontal ecological protection compensation mechanism can effectively integrate the ecological resources of different areas in the basin and promote ecological balance and mutual benefit sharing in the basin.Focusing on the historical orientation of high-quality development of the Yellow River Basin,Shanxi Province has carried out the pilot work of horizontal ecological compensation mechanism in the Fenhe River Basin.However,since Shanxi Province is still in the preliminary exploration stage,there are practical dilemmas such as insufficient supply of legal norms,lack of market-oriented and diversified compensation,and queer safeguard mechanism,which are in urgent need of theoretical exploration.Combined with the implementation of the pilot situation,the reference of practical experience in other regions,improve the local laws and regulations as the basis,the government normative documents as a complementary normative system,the construction of government-led,market-assisted diversified compensation,while strengthening the supervision mechanism,the social participation mechanism and incentives to protect the mechanism of the three levels of the three levels of the proposed approach to improve,with a view to promoting the pilot project of the Fenhe River Basin in Shanxi Province,the horizontal ecological protection of the compensation work.In order to promote the pilot work of horizontal ecological protection compensation in Fenhe River Basin in Shanxi Province and guarantee the healthy development of the ecological environment in Fenhe River Basin.
