流域生态保护横向补偿机制的法治实现——以横向转移支付为切入点

摘　　要：《生态保护补偿条例》的颁布正式确立了流域生态保护领域横向补偿的适用正当性,旨在以横向转移支付手段解决流域内区域间利益冲突的补偿问题,但我国《预算法》确立的转移支付制度中缺乏对横向转移支付的直接规定。为了将流域生态保护横向补偿纳入财政法治化范围内,应当从流域生态补偿的理论证成出发,明确流域横向补偿的正当性与必要性。为了保障法律体系的一致性和法律实施的便利,宜在未来推动《区域合作法》立法和区域协同立法,协调中央政府及作为区域利益代表的地方各级政府在流域生态保护补偿中的权责划分,做到事权和支出责任相适应。The promulgation of the“Regulations on Compensation for Ecological Protection”formally establishes the legitimacy of the application of horizontal compensation in the field of ecological protection in the watershed,aiming at solving the problem of compensation for the conflict of interests between regions in the watershed by means of horizontal transfer,but the transfer system established by“China’s Budget Law”lacks the direct provisions on horizontal transfer.In order to include horizontal compensation for ecological protection in the watershed within the scope of financial rule of law,the justification and necessity of establishing horizontal compensation in the watershed should be clarified from the theoretical proof of ecological compensation in the watershed.In order to guarantee the consistency of the legal system and facilitate the implementation of the law,it is appropriate to promote the legislation of the“Regional Cooperation Law”and the legislation of regional synergy in the future,and to coordinate the division of powers and responsibilities between the central government and local governments at all levels as representatives of the regional interests in the compensation for ecological protection in the river basins,so as to make the rights and responsibilities for expenditures compatible.
