摘　　要：飞地经济本质上是地方政府之间因应区域经济协同发展、资源整合等需求而积极开展跨区域生产要素合作的重要产物之一,其在实践中蕴含着不可估量的经济价值。然而,飞地经济的空间生产对我国现行的行政管理体制和属地管辖原则提出了新的挑战。当前我国的行政管理体制及财政事权的安排通常是以传统的行政区划及边界为限,飞地作为跨区域合作生产的新兴空间,天然的跨界属性导致其无法获得合法的主体身份。飞地经济内在的自下而上的地方制度试验性特征决定了中央权力参与其中并发挥统领作用的必要性。应当从确认府际协议法律效力、完善飞地行政管理体制、建立飞地财政合作规则等方面,优化飞地法治环境,为飞地经济的空间生产提供坚实的法治保障。The enclave economy is essentially one of the important products of the cooperation between local governments to actively carry out cross-regional production factor cooperation in response to the needs of regional economic coordinated development and resource integration.It contains inestimable economic value in practice.However,the space production of the enclave economy poses new challenges to my country's current administrative management system and territorial jurisdiction principles.The current administrative management system and fiscal power arrangements in my country are usually limited by traditional administrative divisions and boundaries.As a new space for cross-regional cooperative production,"enclaves"have natural cross-border attributes that make them unable to obtain a legal subject status.The inner bottom-up experimental characteristics of the local system in the enclave economy determine the necessity of the central power to participate and play a leading role.It is necessary to optimize the legal environment of the enclave from the aspects of confirming the legal validity of the intergovernmental agreement,improving the administrative management system of the enclave,and constructing the enclave financial cooperation mechanism,so as to provide a solid legal guarantee for the space production of the enclave economy.
