版权数字救济中封网禁令实施困境的因应之策

摘　　要：随着数字技术的发展,传统的“安全港规则”已无法及时有效地保护版权人的利益。欧美各国在立法或司法实践中采取“封网禁令”的版权数字救济措施,以此弥补安全港规则的不足。封网禁令在实施过程中面临动态变化的数字环境、依赖私人掌握的技术黑箱、触及广泛的权利主体等问题。目前封网禁令的技术方案主要包括:IP封锁、DNS封锁、URL封锁、DPI封锁、平台过滤。不同的技术方案具有不同的优缺点,关系到权利救济的实效问题。有关封网禁令的裁判只是版权数字救济的起点,法院在执行阶段仍需保持积极介入。封网禁令本土化建构过程中,中国可以吸收英美法的有益实践经验,探索封网禁令实施过程的管理制度,提高版权数字救济的实效性。With the development of digital technology,the traditional safe harbor rule can no longer protect the interests of copyright owners in a timely and effective manner.Countries in Europe and America have adopted the"blocking injunction"as the digital remedy in legislation or judicial practice to make up for the inadequacy of the safe harbor rule.In the process of implementation,the blocking injunction faces such issues as the digital environment changing dynamically,the black box relying on the privately-held technology,and the subjects of rights involving a wide range.The current technical solutions of blocking injunction mainly include the IP blocking,DNS blocking,URL blocking,DPI blocking,and platform filtering.Different technical solutions have their own advantages and disadvantages,which are related to the effectiveness of the remedy of rights.The verdict of blocking injunction is only the starting point for the digital remedies for copyright,and the court still needs to actively intervene in the enforcement stage.In the process of local construction of blocking injunction,China can learn from the useful practical experience of common law,explore the management system of the implementation process of blocking injunction,and improve the effectiveness of digital remedies for copyright.
