摘 要:建设工程价款优先受偿权本质上属于法定担保物权,合同无效并不会影响其效力,优先受偿权的请求权主体不仅包括无效合同的承包人,还包括实际施工人。为了切实保障优先受偿权的实现,应明确赋予优先受偿权一定的追及效力,使承包人有权在建筑物转让情形下请求受让人优先受偿。但对承包人优先受偿权的追及效力应作出一定的限制,只有在承包人的积极行为产生公示效力时,才能使优先受偿权的追及效力作用于第三人所有的建筑物之上。优先受偿权不可追及至商品房消费者受让的房屋上,但可转移为对商品房消费者购房价款的请求权。The construction project payment priority claim is essentially a statutory security interest,and its validity is not affected by the invalidity of a contract.The entities entitled to priority claim include not only contractors of invalid contracts but also actual builders.To effectively safeguard the realization of priority claim,it is essential to explicitly grant certain retroactive force to the priority claim,enabling the contractor to request priority from the transferee in the event of the transfer of the building.However,the force should be subject to certain limitations,which can only act upon buildings owned by third parties when the contractor’s positive actions produce a publicity effect.It cannot be pursued on houses transferred to commercial housing consumers,but it may be appropriately transferred onto the payments made by the commercial housing consumers.
