摘　　要：《档案法》法律责任条款是惩治档案违法行为的规范依据,也是贯彻立法目的的基本方略,兼具保障档案安全、促进档案利用、深化档案法治三重功能。即便如此,《档案法》法律责任条款依然存在档案违法行为列举不全、档案行政处罚畸轻、档案行政处罚监督缺位等问题,阻碍着法律责任条款规范功能的发挥。对此,应当结合档案法制建设状况有针对性地予以完善。一是设置兜底条款,平等保护不同性质档案;二是引入“双罚制”,全面提升档案行政处罚力度;三是依托检察机关,强化档案行政处罚外部监督。The legal liability provisions of the Archives Law are the normative basis for punishing archives violations,and are also the basic strategy for implementing the legislative purpose,with the triple function of safeguarding archives security,promoting archives utilization and deepening the rule of law for archives.Even so,the legal liability provisions of the Archives Law still exists archives violations enumerated incomplete,archives administrative penalties are too light,archives administrative penalties supervision is missing and other issues,hindering the normative function of the provisions of the legal liability to play.In this regard,it should be combined with the archives of the legal system to be targeted to improve the situation.The first is to set up a"bottom-up"clause to protect archives of different natures on an equal footing;the second is to introduce a"double-penalty system"to enhance the strength of administrative penalties for archives;and the third is to rely on procuratorial organs to strengthen the external supervision of administrative penalties for archives.
