基于PMC指数的地方档案立法质量评价研究——以省级档案法规为例

摘　　要：通过对我国省级档案法规进行立法质量评价,可以为立法部门制订科学、规范、可操作的地方档案法规提供参考参考依据。选取我国省、自治区、直辖市出台的31个地方档案法规,利用PMC指数模型构建立法质量评价体系,对省级档案法规文本内容展开测评,并从立法目标、立法技术、责任确定、立法内容等九个维度进行质量评价与对比分析。研究表明:我国省级档案法规立法质量整体较好,但部分省份档案法规与地方档案管理实际需要尚有差距,存在立法技术不完善、立法内容覆盖面不足、地方特色不突出等问题,在未来立法时应重点关注以上问题,不断修订和完善地方档案法规,以良法促善治。By evaluating the legislative quality of provincial archives regulations in my country,it can provide a reference for legislative departments to formulate scientific,standardized and operational local archives regulations.31 local archives regulations issued by provinces,autonomous regions and municipalities directly under the central government were selected,and a legislative quality evaluation system was constructed using the PMC index model.The text content of provincial archives regulations was evaluated,and quality evaluation and comparative analysis were conducted from nine dimensions,including legislative objectives,legislative techniques,responsibility determination,legislative content and so on.The study shows that the legislative quality of provincial archives regulations in china is generally good.However,there is still a gap between the archives regulations of some provinces and the actual needs of local archives management.There are problems such as imperfect legislative techniques,insufficient coverage of legislative content,and lack of local characteristics.In future legislation,we should focus on the above issues,continuously revise and improve local archives regulations,and promote good governance with good laws.
