摘　　要：粮食企业社会责任储备制度关系国家粮食安全战略的落实。政府作为粮食安全保障的主要责任主体,其权责的厘清是社会责任储备制度构建的核心内容。实践中,粮食企业社会责任储备主要以合同方式建立,但囿于合同关系不清、性质不明,政府权责的设定存在诸多问题。为此,有必要在事先明确社会责任储备不同阶段所涉合同关系和性质的基础上,进一步明确政府权责:首先,社会责任储备建立阶段签订的合同属于储备服务合同,因其具有较强的行政合同色彩,政府被赋予了对社会责任储备公权意义上的监管权;其次,社会责任储备动用阶段签订的合同属于基于预先权利设定的储备买卖合同,其赋予了政府在日常时点对特殊情况发生时以购买方式取得储备所有权的期待权;最后,社会责任储备合同的缔结遵循企业自愿原则,政府对价给付责任的明晰应当以激励企业自愿缔结合同为目标,注重细化储备服务的激励措施和储备动用的结算标准。The social responsibility reserve system of grain enterprises is related to the implementation of the national food security strategy.As the main responsible body for ensuring food security,the clarification of the government's powers and responsibilities is the core content of constructing a social responsibility reserve system.In practice,the social responsibility reserve of grain enterprises is mainly established through contracts,but due to unclear contractual relationships and unclear nature,there are many problems in the setting of government's powers and responsibilities.There fore,it is necessary to first clarify the contractual relationships and nature involved in the social responsibility reserve at different stages,and then further clarify the government's powers and responsibilities.1)The contract signed during the establishment stage of social responsibility reserve belongs to reserve service contracts,and.due to their strong administrative contract characteristics,the government is granted regulatory power in the sense of public authority over social responsibility reserve;2)The contract signed during the utilization stage of social responsibility reserves belongs to the reserve purchase and sale contract based on the pre-set powers,which grants the government the expectation right to acquire reserve ownership through the purchase in the event of special circumstances on a daily basis;3)The conclusion of social responsibility reserve contracts follows the principle of voluntary participation by enterprises,and the clarification of government payment responsibilities should aim to encourage enterprises to voluntarily sign the contracts,with a focus on refining incentive measures for reserve services and settlement standards for reserve utilization.
