摘　　要：社会主义核心价值观融入判词可以辅助法律论证实现说服,但该项工作的进展并不畅顺。法官往往严格依法裁判坚持形式推理而不重视法律论证的多元形式以及司法裁判的价值承载,对价值判断和道德论证持否定态度;同时,法官对修辞论证手段陌生,为避免社会主义核心价值观运用不当引发负面评价,倾向于采取防卫式说理策略。修辞论证作为一种非形式逻辑的法律方法,需要法官以开放的姿态对待制定法之外的说理资源,重视听众意见,借助商谈对话和情感激发促成共识,提升司法裁判的合理性和可接受性。将社会主义核心价值观作为修辞论证资源时,法官要以法律方法论为理论支撑,识别融入情境、准确定位角色并妥当修辞表达,方可有效发挥其积极功能。The integration of socialist core values into the court verdict can help the legal argument to persuade both parties, but the integration work has not gone smoothly. On the one hand, judges tend to judge strictly according to law, adhere to formal reasoning but not pay enough attention to the multiple forms of legal argument and to the value bearing of judicial judgment, and often hold a negative attitude towards value judgment and moral argument. On the other hand, few judges are familiar with rhetorical argumentation. They tend to adopt defensive reasoning strategies to avoid negative evaluation caused by improper reference of socialist core values in their reasoning. Rhetorical argument, as a legal method of informal logic, requires judges to be open to reasoning resources outside the law, attach importance to the audience's opinion, and promote consensus through negotiation, dialogue and emotional resonance, so as to enhance the rationality and acceptability of judicial decisions. When taking the socialist core values as the rhetoric argument resources, judges should take the legal methodology as theoretical support, identify the scenarios, accurately position the role of the socialist core values and properly express the rhetoric, so as to effectively play its positive function.
