新兴技术提升跨域环境司法效能的应然逻辑与实现理路:以区块链技术为视角

摘　　要：生态环境的整体性与行政司法体制分割性之间的矛盾,使得跨域环境司法成为常态。目前,跨域环境司法存在结构性失衡、系统性困境和规范性不足等诸多局限,而区块链技术的多中心机制、分布式记录、信任创造、防篡改以及共识机制等优势,使其能够适用于多主体、跨区域写入的司法应用场景,恰好契合跨域环境司法的天然属性、提升跨域环境案件的司法效能和优化跨域司法的职权配置。区块链技术有助于完善环境司法存证制度、赋能智慧环境审判、提升环境诉讼服务质效、优化环境两法衔接程序和提升环境司法协作效能。区块链技术驱动跨域环境司法的发展前景,应当是以司法区块链联盟为基础打造跨域环境合作平台、以跨域环境类案为先导引领区块链技术平台建设和以人工智能发展为契机助力区块链环境司法推进。The contradiction between the integrity of the ecological environment and the fragmentation of the administrative judicial system has made cross domain environmental justice the norm.At present,there are many limitations in cross domain environmental justice,such as structural imbalance,systemic dilemma,and insufficient standardization.However,the advantages of blockchain technology,such as multi center mechanism,distributed recording,trust creation,tamper proof,and consensus mechanism,make it suitable for judicial application scenarios with multiple subjects and cross regional writing,which perfectly fits the natural attributes of cross domain environmental justice,improves the judicial efficiency of cross domain environmental cases,and optimizes the power allocation of cross domain justice.Blockchain technology can help improve the environmental judicial evidence system,empower smart environmental trials,enhance the quality and efficiency of environmental litigation services,optimize the process of connecting environmental laws and improve the efficiency of environmental judicial cooperation.The development prospects of cross domain environmental justice driven by blockchain technology should be based on the Judicial Blockchain Alliance to create a cross domain environmental cooperation platform,leading the construction of blockchain technology platforms with cross domain environmental cases as the guide,and using the development of artificial intelligence as an opportunity to assist in the promotion of blockchain environmental justice.
