摘　　要：探讨我国生成式人工智能版权补偿金制度的建构,以期实现版权人利益保护与生成式人工智能技术发展之间的平衡,促进二者良性发展。文章梳理了生成式人工智能所引发的版权人利益实现困境,包括版权作品使用的许可利益取得困难,版权作品衍生使用的开发利益取得困难,作品侵权损害赔偿取得困难。阐释版权补偿金制度的原理,并借鉴国外的版权补偿金制度,分析生成式人工智能对接版权补偿金制度的业态路径,认为在生成式人工智能专业模型层对接版权补偿金制度较为恰当,并提出生成式人工智能版权补偿金制度的具体建构策略,包括明确补偿支付主体身份、优化补偿收缴工作主体、采取“比例+单一”的复合补偿标准、建立公私利益相互补充的补偿分配体系。In recent years,copyright owners and artificial intelligence platforms have engaged in intense discussions and confrontations at the judicial level regarding whether compensation should be given for the use of copyrighted works by generative artificial intelligence.Through the analysis of the existing cases,it can be found that the dissatisfaction of copyright holders towards artificial intelligence platforms mainly stems from the lack of due respect for their copyright interests.The article attempts to analyze the difficulties in realizing the interests of copyright owners caused by generative artificial intelligence,draw on foreign copyright compensation systems,and explore the construction of China's generative artificial intelligence copyright compensation system,in order to achieve a balance of interests between copyright owners and artificial intelligence platforms.The research process is mainly divided into four parts.Through literature review and case analysis,clarify the difficulties in realizing the interests of copyright owners caused by generative artificial intelligence;introduce the principles of the copyright compensation system and the construction of the copyright compensation system in foreign countries;by drawing on the existing research results,propose a path for integrating generative artificial intelligence with copyright compensation systems;based on the analysis of the relevant domestic and international experiences,propose the specific strategies for constructing a copyright compensation system at the professional model layer.Research has found that the difficulties in realizing the interests of copyright owners caused by generative artificial intelligence include the difficulties in obtaining the license benefits for the use of copyright works,the difficulties in obtaining the development benefits for the derivative uses of copyright works,and the difficulties in obtaining the compensation for infringement damages of works.To reconcile the imbalance of interests between copyright owners
