摘  要:在当前醉酒型危险驾驶犯罪“醉酒驾驶行为+血液酒精含量+刑事责任情节”的入罪与量刑模式中,刑事责任情节的理解与适用已经成为定罪与量刑的关键性因素。种类数量增加以及适用场域扩展促使刑事责任情节的认定与适用呈现出体系化特征。而“逃避、阻碍检查”情节认定在司法实践中存在一定的混乱与疑难,其原因正是抽象危险性判断缺乏体系标准、体系化运用层次把握不足、体系化外部衔接缺失等问题的存在。因此可通过建构类型化因素的抽象危险性判定体系,优化刑事责任场域的层次适用,完善“逃避、阻碍检查”情节的分层认定与适用路径。In the current criminalization and sentencing model of drunk driving crimes,which is"drunk driving behavior combined with blood alcohol content and criminal responsibility circumstances",the understanding and application of criminal responsibility circumstances have become key factors in conviction and sentencing.The increase in the number of types and the expansion of application fields have led to the systematization of the identification and application of criminal responsibility circumstances.However,there is a certain degree of confusion and difficulty in the identification of the"evading or obstructing inspection"circumstance in judicial practice.The reasons for this are the lack of systematic standards for the judgment of abstract danger,insufficient grasp of the application levels in the criminal responsibility field,and the absence of systematic external connections.Therefore,it is possible to construct a systematic judgment system for the abstract danger of typified factors,optimize the hierarchical application of the criminal responsibility field,and improve the hierarchical identification and application path of the"evading or obstructing inspection"circumstance.
