废旧农膜回收和处置的制度困境与完善进路

摘　　要：农膜污染防治工作在取得成绩的同时,仍面临着生产、销售企业回收力度不足、农户参与回收积极性不高、废旧农膜总体资源化利用率不高等问题。对此,我国初步建立了废旧农膜回收和处置制度体系,但存在责任分配不明、制度衔接障碍、激励制度异化、法律责任过轻甚至缺失等问题。鉴于此,应从合理分配主体责任、确保制度的内外部衔接、完善激励制度、提高法律责任约束力度几个方面,完善废旧农膜回收和处置制度体系。While achieving certain progress in the prevention and control of agricultural film pollution,there are still issues such as insufficient recycling efforts from production and sales enterprises,low enthusiasm among farmers for participating in recycling,and a relatively low overall resource utilization rate of waste agricultural films.In this regard,China has also initially established a system of agricultural film recycling and disposal system,but there are problems such as unclear responsibilities,barriers in system integration,alienation of incentive system,insufficient or even absent legal liabilities,lack of information disclosure system and insufficient public participation in the construction of the system.In view of this,the main responsibility should be clarified from the scope of the system,to ensure the internal and external connection of the system,improve the incentive system,improve the legal responsibility constraints,improve the information disclosure system and the public participation system in several aspects,improve the agricultural film recycling and disposal system.
