闲置土地规制体系的失能样态与完善路径——基于系统论法学视角

摘　　要：土地闲置是国有建设用地低效配置的集中体现。透过系统论法学“功能分化”“运作封闭”“结构耦合”等分析工具审视闲置土地规制体系,可以发现,闲置土地法律系统在运作封闭上存在缺失,同时分别与政治、经济系统存在结构耦合上的松散和偏失,导致功能发挥不足。对此,应锚定实现闲置土地法律系统与政治、经济系统整体功能提升的规制目标,完善闲置土地规制体系。一是要健全闲置土地法律系统的规范结构,有效发挥法律功能;二是要强化闲置土地法律系统与政治系统的结构耦合,促进功能互嵌;三是要矫正闲置土地法律系统与经济系统的结构耦合,实现功能互助。Idle land is a concentrated manifestation of the inefficient allocation of state-owned construction land.By examining the idle land regulation system and its operation through the analysis tools of system theo ry of law,such as“functional differentiation”,“operational closure”,and“structural coupling”,it can be found that the legal system of idle land has defects in operational closure,and meanwhile,there are loose and biased structural coupling with the political and economic systems,which results in insufficient function.In this regard,we should anchor the regulatory goal of improving the overall function of the legal system,politi cal system,and economic system of idle land,and improve the regulatory system of idle land:first,to perfect the normative structure of the legal system of idle land and to give full play to legal functions;second,to strengthen the structural coupling between the legal system and political system of idle land and to promote the mutual embedding of functions;third,to correct the structural coupling between the legal system and eco nomic system of idle land and to realize the mutual assistance of functions.
