“一国两制”台湾方案中的两岸法治融合

摘　　要：国家完全统一后,在确保国家主权、安全、发展利益的前提下,台湾地区原有的部分规定经过必要调整后继续存在,台湾地区从中国内部两岸政治对立状态下的一个特殊法域演进成为国家完全统一状态下的独立法域。在推进“一国两制”台湾方案实践过程中,两岸交流融合深化将会衍生出更多问题,但两岸政治对立结束及各自规定衔接协调也使得两岸法治融合具有更为扎实的基础和多元的路径。在“一国两制”宪制秩序下,基于法域本位重构台湾法治体系、妥善协调两岸区际法律冲突、拓展两岸共同法律事务治理、推进两岸协同立法和协议适用,以及探索构建跨域统一法律机制,是健全两岸融合发展法治保障、推动中国台湾融入国家发展大局和民族复兴伟业、确保统一后长治久安和繁荣发展的应有之义。After China’s complete reunification,on the premise of ensuring national sovereignty,security,and development interests,some of the original regulations in the Taiwan region will continue to exist after necessary adjustments.The Taiwan region will evolve from a special jurisdiction under the state of political confrontation between the two sides within China to an independent jurisdiction under the state of complete reunification.In the practice of promoting"One Country,Two Systems"Taiwan Plan,the deepening of cross-Strait exchanges and integration will lead to more problems,but the end of cross-Strait political confrontation and the coordination of their respective regulations also make the cross-Strait legal integration have a more solid foundation and diversified paths.Under the constitutional order of"One Country,Two Systems"and jurisdiction-based orientation,it is imperative to reconstruct Taiwan's legal system,properly coordinate cross-Strait regional legal conflicts,expand cross-Strait common legal affairs governance,promote cross-Strait collaborative legislation and the application of agreements,and establish a unified legal mechanism across different regions,in order to improve the legal guarantee for cross-Strait integrated development,promote Taiwan's integration into the overall national development and the great cause of national rejuvenation,and ensure long-term stability,prosperity and development after reunification.
