摘　　要：行政立法者是宪法的直接实施者,行政法典的编纂应当以宪法为依据,接受宪法的价值指引和规范调控。在中国式现代化的宪制实践层面,国家治理现代化的宪法精神、行政权力的宪法变迁与法治政府建设的宪制转型,都亟待通过行政法典编纂给予整体性回应。行政法典编纂的目的是实现行政法体系化,促成价值融贯的行政法秩序,宪法中的法制统一、人权保障与权力限制价值可以为此提供价值依托。为了推动形成更加系统完备的行政法律知识体系,需要得到宪法规范的支撑。具体而言,宪法对人大制定基本法律的要求为行政法典编纂提供立法权力来源,宪法中的行政任务和部门职能确立了行政法典的立法内容构成,宪法的最高规范效力划定行政法典的立法裁量边界。The administrative legislator is the direct implementer of the Constitution,and the compilation of the administrative code should be based on the Constitution and accept the value guidance and normative regulation of the Constitution.At the constitutional practice level of Chinese modernization,the constitutional spirit of the modernization of state governance,the constitutional change of administrative power and the constitutional transformation of the construction of a government ruled by law are all in urgent need of a holistic response through the compilation of administrative codes.The purpose of compiling administrative code is to realize the systematization of administrative law,promote the formation of an administrative law order with consistent values,and the unity of legal system,the protection of human rights and the limitation of power in the Constitution can provide fundamental value support for this.In order to promote the formation of a more systematic and complete knowledge system of administrative law,it is necessary to get the support of constitutional norms.Specifically,the requirement of the Constitution for the National People's Congress to formulate basic laws provides a source of legislative power for the compilation of administrative codes,the administrative tasks and departmental functions in the Constitution establish the legislative content composition of administrative codes,and the highest normative effect of the Constitution delineates the legislative discretion boundary of administrative codes.
