摘　　要：对地方性法规进行解释是我国立法工作“立改废释”中的重要环节。地方性法规解释除了立法解释外,还需要进行行政解释。但是,目前我国的地方性法规行政解释制度存在法律依据不足、解释主体较为混乱、解释程序不规范等突出问题,这显然不利于地方性法规的有效实施。应积极推进地方性法规行政解释制度的法治化构建进程,这是立法规范适用的必然要求,是提升地方风险治理能力法治化水平的有效路径,也是协调不同层级解释、规制各类执法解释的迫切需要。为此,要以法律的形式明确规定地方性法规的行政解释制度,明确同级政府作为地方性法规行政解释的唯一主体,完善优化解释程序和解释方法,并赋予行政解释更高的法律效力,更好发挥行政解释在地方性法规实施中的积极作用。The interpretation of local regulations is an important part of the legislative work of“establishing,amending,abolishing,and interpreting”.In addition to the legislative interpretation,the administrative interpretation of local regulations needs to be strengthened.However,at present,there are some prominent problems in the administrative interpretation system of local regulations,such as lack of legal basis,confusion the subject of interpretation,and nonstandard interpretation procedure,which are not conducive to the effective implementation of local regulations.The process of legal system construction of administrative interpretation of local regulations should be actively promoted,which is the inevitable requirement of the application of legislative norms,effective way to improve the level of legal system of local risk governance capacity,and the urgent need to coordinate and regulate various law enforcement interpretations.It is necessary to clearly stipulate the administrative interpretation system of local regulations in the form of law,to clarify the same level of government as the subject of administrative interpretation of local regulations,to improve and optimize the interpretation procedure and interpretation methods,and to give it higher legal effect,so as to better play the role of administrative interpretation in the implementation of local regulations.
