摘　　要：在专利侵权程序中,可能会适用禁止反悔原则,将在专利授权确权程序中基于可专利性的要求而放弃的技术方案不再纳入专利权的保护范围之内。当从属权利要求的特征加入被引用的权利要求时,可以基于从属权利要求的不同类型来明确申请人或专利权人为了使权利要求具有专利性而作出放弃的意思表示,从而确定其放弃的方向,进而在该方向而非其他方向上适用禁止反悔原则,使得该适用具有可操作性。Prosecution History Estoppel may be applied in a patent infringement procedure,and a technical solution surrendered in a patent granting or confirmation procedure to meet the statutory requirements for patentability should not be encompassed in the claimed scope of protection.In case that the feature of a dependent claim is introduced in a claim to which the dependent claim refers,it is needed to identify the declaration of will of the applicant or patentee for surrendering the technical solution based on the type of the dependent claim,whereby ensuring a direction of the surrender,and the application of Prosecution History Estoppel may be practical along the direction rather than others.
